Welcome to Unclutter Mind! These Terms and Conditions ("Agreement") govern your use of Unclutter Mind’s website, located at [https://uncluttermind.com] ("Website"), and the services provided by Unclutter Mind ("Company"). By accessing our Website or booking a session, you confirm that you have read, understood, and agreed to be legally bound by these terms. The Company reserves the right to modify this Agreement at any time without prior notice.
1. Definitions
1.1. "Company" refers to Unclutter Mind, its employees, and affiliated therapists.
1.2. "Client" refers to any individual who books a therapy session or uses Unclutter Mind’s services.
1.3. "Therapist" refers to licensed professionals or trained mental health practitioners working with Unclutter Mind.
1.4. "Session" refers to a scheduled therapy or consultation appointment.
2. Mental Health Services
2.1. Unclutter Mind provides therapy and counseling services using an eclectic approach, customizing techniques to suit each client’s unique needs.
2.2. Therapists do not prescribe or provide medical guidance regarding medications. If medical intervention is required, clients must seek a licensed medical professional.
2.3. Therapy results vary; Unclutter Mind does not guarantee specific outcomes.
2.4. Therapy sessions are confidential, subject to exceptions outlined in this Agreement.
2.5. Therapists may refer clients for medical evaluations of clinical psychologists or psychiatrist if deemed necessary; following such recommendations is the client's responsibility.
2.6. By booking a session, clients explicitly consent to receive therapy under these terms and acknowledge that therapy is not a substitute for medical or psychiatric treatment.
3. Booking and Payment
3.1. All therapy sessions must be booked and paid for in advance through our Website.
3.2. Upon booking, clients receive a confirmation email with the session details, including the link for virtual consultations.
3.3. Payments are processed securely via Razorpay and include options such as UPI apps (GPay, PayTM, PhonePe), direct bank transfer, and credit/debit cards.
3.4. Any additional taxes or fees applicable will be displayed at checkout.
4. Cancellation, Rescheduling, and No-Show Policy
4.1. No refunds will be issued for canceled sessions, except in cases of double payments, accidental bookings, or technical failures on Unclutter Mind's end.
4.2. Clients may reschedule with at least 24 hours' notice. Rescheduling within 24 hours is not permitted, and the session fee is forfeited.
4.3. Clients arriving more than 10 minutes late without prior notice will be marked as a no-show, and the session fee will be forfeited.
4.4. If the therapist reschedules due to an emergency, the client may either reschedule at no additional cost or receive a full refund.
4.5. Dissatisfaction with therapy outcomes does not qualify for a refund.
4.6 To reschedule a session, send a message to 8107845322 at least 24 hours before your scheduled session. You will receive a link to book your next slot.
4.7 Rescheduling is free of cost, but a session can be rescheduled only twice. More than two reschedules for the same session will not be allowed.
5. Confidentiality and Data Protection
5.1. All therapy sessions are confidential. Client records are securely maintained and accessible only to the assigned therapist.
5.2. Recording of sessions by clients is strictly prohibited. Unauthorized sharing or dissemination of session content is a violation of this Agreement and may result in legal action.
5.3. Therapists may consult with professionals for supervision while maintaining client anonymity.
5.4. Confidentiality may be breached under the following conditions: - Risk of imminent harm to self or others. - Suspected child abuse, in compliance with the Protection of Children from Sexual Offences (POCSO) Act, 2012. - Legal court orders requiring disclosure.
5.5. Unclutter Mind follows data protection laws, including GDPR compliance where applicable. Client data is stored securely and encrypted to prevent unauthorized access. Client records are retained for five years after therapy termination unless a different legal requirement applies. Clients may request access, rectification, or deletion of their data.
6. Compliance with the Mental Healthcare Act, 2017
6.1. Unclutter Mind adheres to the Mental Healthcare Act, 2017, ensuring the confidentiality of client information except when legally mandated.
6.2. Confidentiality exceptions include threats to life, public safety, and legal orders.
7. Therapy for Minors (Under 18 Years of Age)
7.1. Legal guardians may have access to minors' therapy records unless confidentiality is deemed necessary for the minor’s well-being.
7.2. Therapy requires written parental/legal guardian consent before initiation.
7.3. If the therapist determines an imminent risk of harm, they may disclose necessary information to the minor’s guardian.
8. Ethical and Professional Boundaries
8.1. Client-therapist relationships remain strictly professional; personal, social, or business engagements outside therapy are prohibited.
8.2. Therapists will not engage in private therapy sessions with clients outside Unclutter Mind without the Company’s approval.
8.3. Clients are expected to conduct themselves respectfully during sessions. Any form of harassment, inappropriate conduct, or misrepresentation may result in termination of services without a refund.
9. Liability Disclaimer
9.1. Unclutter Mind and its therapists shall not be held liable for personal, emotional, or professional decisions made by clients based on therapy discussions.
9.2. Therapy services provided by associated therapists are independent; Unclutter Mind is not liable for misconduct or malpractice by therapists.
9.3. Counselling Therapy is not a substitute for medical, psychiatric, or legal advice.
9.4. Unclutter Mind is not responsible for external factors affecting therapy sessions, such as internet connectivity issues, client distractions, or technical failures on the client's end.
9.5. Unclutter Mind’s total liability under this Agreement shall not exceed the amount paid for the most recent session.
10. Crisis and Emergency Disclaimer
10.1. Unclutter Mind does not provide emergency or crisis intervention services.
10.2. Clients in immediate distress should contact local emergency services or crisis helplines.
11. Litigation and Legal Matters
11.1. Unclutter Mind and its therapists do not voluntarily participate in litigation, custody disputes, or other legal proceedings.
11.2. If subpoenaed, the client agrees to compensate Unclutter Mind for time spent on legal proceedings at customary rates.
12. Force Majeure
12.1. Unclutter Mind shall not be liable for delays or failures in performance due to causes beyond its reasonable control, including but not limited to natural disasters, cyberattacks, government actions, or technical failures.
13. Termination of Services
13.1. Clients may terminate therapy at any time by informing their therapist.
13.2. Therapists may discontinue services due to non-compliance, ethical concerns, or inappropriate client behavior.
13.3. If therapy is terminated, the client may request referral options for continued care.
14. Certifications
14.1 Any certification provided upon completion of a workshop or training is solely to acknowledge and celebrate the participant’s accomplishment. It does not grant a practitioner license or professional qualification. To practice as a certified professional, additional formal training, supervised practice, and licensing from a recognized institution are required.
15. Dispute Resolution & Governing Law
15.1. Any disputes arising from this Agreement shall first be attempted to be resolved through mediation or arbitration before legal action is taken.
15.2. Mediation shall be facilitated by a neutral third party agreed upon by both parties.
15.3. This Agreement shall be governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.
16. Indemnification
16.1. Clients agree to indemnify and hold Unclutter Mind harmless from any claims, damages, or losses resulting from their actions or misinterpretation of therapy advice.
17. Intellectual Property and Website Usage
17.1. All content on the Website, including therapy tools, worksheets, and written material, is the property of Unclutter Mind and may not be copied, distributed, or used without explicit permission.
18. Acknowledgment of Terms By booking a session, you acknowledge that you have read, understood, and agreed to these terms and conditions. Your continued use of Unclutter Mind’s services constitutes legal acceptance of this Agreement.
